Lauren Howard surprised fleet executives at the 2017 CCJ Innovator of the Year summit in Duck Key, Fla., on Feb. 10, when she explained what the Celadon Group is doing for owner operators.Howard is president of the Celadon Group’s over-the-road truckload division. Celadon was recognized as the 2015 CCJ Innovator of the Year for the new technology and career path it created for its customer service department. At the 2017 Innovator summit, Howard gave attendees recognized as innovators by CCJ in 2016 and in years past a reason to believe the owner-operator model is alive and well. Rather than scale back or retreat from the owner-operator model, as many fleets have done, Celadon has gone all in, she said.Giving drivers controlA true independent owner-operator owns equipment, has a DOT number, and has freedom to book loads from any shipper, broker or carrier. A leased owner-operator rents equipment from a carrier and runs under its DOT number.About 60 percent of Celadon’s fleet are independent contractors of both varieties. Employee drivers comprise the other 40 percent. In the eyes of tax collectors, leased owner-operators are more similar to employees than true independents since the carrier arguably has more control over them. One area where control might be an issue is the dispatch process.Changes that Celadon made to its customer service department earned it the distinction of the 2015 CCJ Innovator of the Year.Recognizing this risk, Celadon sought a solution that would give its leased contractors the freedom to choose more loads. CCJ Innovators profiles carriers and fleets that have found innovative ways to overcome trucking’s challenges. If you know a carrier that has displayed innovation, contact CCJ Chief Editor Jason Cannon at [email protected] or 800-633-5953.Safety inspection data routinely finds that roughly one in every four commercial trucks is on the road with an out-of-service violation. Often these defects should have been discovered during pre- and post-trip inspections and documented on a Driver Vehicle Inspection Report (DVIR).The Department of Transportation (DOT) fines carriers for noncompliance with DVIR regulations, with penalties ranging from $1,270 per day for not completing a DVIR to $15,420 for not fixing a reported safety defect. There isn't an official DVIR form. Fleets are free to buy them or make their own as long as they show basic required information like vehicle identification numbers, inspection dates and times, the signature of the driver who prepared the report, and the signature of a mechanic or other company official if a defect was found, among other items. Penske Truck Leasing in July launched an electronic driver vehicle inspection report (eDVIR) feature in the Penske Driver mobile app for its customers. This new feature enables customer truck drivers to submit driver vehicle inspection reports electronically using the free Penske Driver app.Drivers previously had to fill out a manual DVIR and if they discovered a defect while completing the paper form, they (or their fleet manager) would then have to contact Penske to schedule an appropriate repair. The new eDVIR functionality provides fleet managers with immediate access to the submissions sent through the app using Fleet Insight, Penske's real-time fleet management platform. This advancement aims to streamline inspection processes, enhance compliance and improve overall fleet management efficiency."Our new eDVIR capability represents a step forward in how we support our customers' compliance and maintenance needs," said Brandie Searle, vice president of digital product management for Penske. "By responding to customer feedback with this highly requested feature we enable electronic submissions and real-time visibility, helping fleet managers address issues quickly and effectively, reducing downtime and improving operational efficiency."Partner InsightsInformation to advance your business from industry suppliersApp-based accountability Submissions are entered into the Penske Driver app and are visible within Fleet Insight. They are marked either DOT Critical (repairs are found, repair order opened) or eDVIR Passed (no further action needed). If a repair is needed, details are automatically sent to Penske's proprietary maintenance systems. Fleet Insight then provides status updates of the request. Because this system is centralized, the Fleet Manager and Driver will have visibility to the submission regardless of where the defect occurs."When submitting an eDVIR through the Penske Driver app, the request is submitted automatically into Penske's internal maintenance systems," Searle said. "The entire process of addressing the issue is tracked digitally, ensuring the issue is resolved. Penske's solution also provides access to a digital history of all DOT Critical defects and subsequent repairs, ensuring technicians cannot disregard DVIRs."The eDVIR feature is designed to help users stay compliant with Department of Transportation regulations. No help from customer services or solicitors . I'm so stressed Hi, @Lilyrose You tell us that the CCJ against you has been escalated to the High Court and a Writ Of Control issued(PS. Are you a business or perhaps self-employed? It’s somewhat unusual for a normal domestic customer to be the subject of such a writ - mainly because they have few goods worth seizing to repay the debt anyway). That being the case then you are somewhat beyond talking to customer support. All communication about the Writ needs to be with the High Court Enforcement officers.(High Court Enforcement Officers are the people you may have seen on telly who can go round and seize goods/property to pay debts - ‘Can’t pay we’ll take it away’ and similar). What is a Writ of Control?A Writ of Control is a court order issued by the High Court. It gives you the power to employ High Court Enforcement Officers (HCEOs), who can seize and sell the judgment debtor’s assets in order to settle the outstanding debt. This method of enforcing a CCJ is often referred to as ‘execution against goods’.A Writ of Control can be used to enforce a CCJ where the amount outstanding is £600 or higher. It can’t be used to enforce a judgment for a debt which is regulated by the Consumer Credit Act 1974 (for example car loans or credit card debt). Such debts can only be enforced by County Court bailiffs. You do not get any notice regarding a Writ of Control being applied for.High Court Enforcement OfficersThe order which allows high court bailiffs to act is known as a ‘writ of control’. The upgrade streamlines the repair request process by automatically sending defect reports from the telematics system to Penske's maintenance system.
